"As a lawyer in San Diego, he found his niche seeking access for people with disabilities. But he's also earned the enmity of thousands of store owners who've received his letters and lawsuits demanding changes to their businesses and money for his efforts.
He tells business owners they're violating the Americans with Disabilities Act... anything from improper warning signs for a handicapped parking space to aisles too narrow for a wheelchair to squeeze through, and then names his price to settle.
Business owners usually choose to pay up, from $300 to several thousand, and make the adjustments rather than go to court.
The act is a wide-ranging law that advocates compare to sweeping civil-rights legislation. It provides protection for the disabled in employment, education and health care, along with ensuring that businesses and facilities are accessible.
California, Florida and Hawaii have state laws that parallel the ADA, and that allow attorneys to seek monetary damages in addition to their fees.
As lawsuits mount, the web site ADAabuse.com says a handful of attorneys have filed 14,000 ADA suits in the past few years – creating concerns about distorting the intent of the law.
